National Security
Overview
BCLP’s National Security Team represents clients that provide goods and services to the government and to other government contractors, as well as those in diverse industries that are affected by evolving national security requirements. The Team’s work includes securing, retaining, and defending challenges to security clearances for individuals and cleared facilities; designing, negotiating, and implementing plans to mitigate and complying with restrictions against Foreign Ownership, Control, and Influence (“FOCI”) of cleared facilities; advising clients regarding mergers, acquisitions, and reorganizations requiring national security reviews by the Committee on Foreign Investment in the United States (“CFIUS”); representing clients involved with classified contracts and contracts requiring access to classified information; addressing litigation and prosecution issues under the state secrets doctrine and the Classified Information Procedures Act; and addressing other issues raised in an evolving national security environment.

Experience
- Represent investment entities, foreign acquirers, and U.S. businesses in national security reviews before the Committee on Foreign Investment in the United States. (CFIUS)
- Represent companies before the Defense Security Service to obtain and maintain facility clearances, including negotiating mitigation of Foreign Ownership, Control, and Influence.
- Represent individuals in obtaining and maintaining personnel security clearances.
- Represented corporate executives, scientists and other cleared employees of major government contractors in adjudications of their security clearances and special access.
- Counselled government contractors and their employees regarding security clearance investigations, responses to government inquiries and polygraph examinations.
- Counselled and assisted corporate entities to obtain or retain facility clearances, and negotiated appropriate mitigation as required, under circumstances of foreign ownership, control or influence (“FOCI”).
