Overview
BCLP’s solid waste practice includes both regulatory and commercial transaction representation. On the regulatory side, we represents owner-operators of municipal solid waste landfills, solid waste transportation firms, recyclers and commercial entities that generate solid waste. As part of this practice, we routinely represent and advise manufacturers and other commercial entities that are not in the solid waste business, regarding their solid and hazardous wastes regulatory obligations.

Experience
- Representing a municipal solid waste landfill permittee in an administrative trial to successfully advocate for the permittee’s right to construct and operate a landfill over allegations of environmental injustice and deficient facility design.
- Negotiating with State regulators over the issuance of solid waste facility permits.
- Advising clients regarding existing and proposed solid waste regulations.
- Advocating on behalf of clients regarding waste-related regulations.
- Representing clients in connection with the purchase of municipal solid waste and C&D landfills.
- Advising clients on ensuring they meet proper due diligence related to the purchase of solid waste facilities and the transfer of solid waste facility permits.
- Drafting contracts for the collection, transport, and management of solid waste services.
