Overview

BCLP lawyers have an extensive and prominent practice assisting clients in the environmental review of projects under the National Environmental Policy Act (“NEPA”) and the state analogues to that statute, particularly in New York and California.  Our attorneys counsel public and private clients in the preparation of environmental impact statements (“EISs”), and in defending against lawsuits brought by project opponents to challenge the approvals granted upon completion of the environmental review process.

Our experience in the area of environmental reviews runs broad and deep – it is not limited to flagship projects such as those highlighted below.  For more than 30 years our lawyers have served as environmental counsel on a wide variety of transportation, development and infrastructure projects across the country.  In many cases our work has encompassed not only counseling with respect to the preparation of environmental impact statements but all associated project-related litigation.

Specifically, BCLP lawyers have experience with:

  • Counseling clients on the Second Avenue Subway in Manhattan, a multi-billion dollar transportation project involving the construction of a new subway running the length of Manhattan, which is currently under construction with funding from the Federal Transit Administration (“FTA”);
  • Counseling clients on the East Side Access project, another FTA-funded project now being built, which will connect the Long Island Rail Road to Grand Central Terminal via a deep rock tunnel running from East 63rd Street to a new terminal located beneath the existing station at  42nd Street in Manhattan;
  • Counseling clients on the $4.9 billion Atlantic Yards project, a mixed-use, LEED-certified development to be constructed on a platform over a rail yard operated by the Long Island Rail Road at the intersection of Atlantic and Flatbush Avenues in Brooklyn and on five adjacent blocks.  The Project includes a new arena for the New Jersey Nets National Basketball Association team, approximately 7 million square feet of commercial and residential space housed in 16 other buildings, 8 acres of publicly accessible open space and parking facilities with more than 3500 spaces;
  • Counseling clients on the Moynihan Station project, a LEED-certified development project involving the construction of a new railroad station (with funding provided by the Federal Railroad Administration) in the historic landmarked Farley Post Office Building in Manhattan;
  • Counseling clients on the Riverside Center project, a proposed 4.5 million square foot, five-building real estate development on the West Side of Manhattan;
  • Counseling clients on the Avalon Green II project, comprised of 444 luxury apartments in 21 buildings on a 68-acre parcel, in the Town of Greenburgh, Westchester County;
  • Counseling clients on the Landmark at Eastview project, a proposed 446 unit age-restricted development on a 100 acre parcel, in the Town of Greenburgh, Westchester County;
  • Counseling clients on the East River Repowering Project at Con Edison’s East River Generating Station in Manhattan; and
  • Counseling clients on the Time Warner Center, a 2.8 million square foot mixed use development in Manhattan.
