Biography

Shane is an experienced litigator and advocate. With over 20 years of experience, Shane has a well-earned reputation for being trustworthy, prepared, and creative. A significant portion of his practice involves representing businesses, municipalities, and other governmental entities navigate complex legal matters. Shane also represents employers in all manner of employment-related matters, including claims of employment discrimination, wage and hour compliance, and employment-related torts and contract actions. In addition, Shane has litigated a number of significant environmental contamination and cleanup actions under Washington state and federal laws.

Shane recognizes that not every case will go to trial, and prioritizes his clients’ business needs and specific objectives, focusing on identifying and pursuing the most efficient and beneficial outcomes, whether by pursuing litigation, arbitration, or mediation.

Shane is a Fellow in the American Bar Foundation and is regularly recognized as a top practitioner in the Washington legal community. He currently serves on the board of Sound Health, one of the largest mental health providers in the Puget Sound region, as well as on the Board of Commissioners for Seattle Youth Soccer Association. When not working, Shane can be found coaching youth sports, backpacking, or watching UW sports.

Experience

  • Defended the City of Seattle in a putative class action brought by property owners and residents arising from the Capitol Hill Occupied Protest (“CHOP”), successfully defeating class certification and obtaining summary judgment dismissal of the majority of plaintiffs’ claims. 
  • Represented the State of Washington in litigating significant environmental claims, ultimately achieving a ~$100 million settlement in favor of the State
  • Defended the Port of Seattle against a $75 million claim by several airport concessionaires that the Port discriminated against them in its leasing practices.
  • Part of the litigation team representing Microsoft in a $4 billion dispute over Motorola’s refusal to license certain standard essential patents on reasonable and non-discriminatory terms. Microsoft prevailed after two trials and two appeals to the Ninth Circuit. Select opinions arising out of the matter include: Microsoft Corp. v. Motorola, Inc., 795 F.3d 1024 (9th Cir. 2015); Microsoft Corp. v. Motorola, Inc., 696 F.3d 872 (9th Cir. 2012); Microsoft Corp. v. Motorola, Inc., 2013 WL 2111217 (W.D. Wash. Apr. 25, 2013).
  • Defended, through multiple appeals to the Ninth Circuit, the Port of Seattle against claims of retaliation in violation of the False Claims Act and the Port’s employee handbook. Select opinions arising out of the representation include: Jonassen v. Port of Seattle, 685 Fed. Appx. 571 (9th Cir. 2017); Jonassen v. Port of Seattle, 550 Fed. Appx. 384 (9th Cir. 2013).
  • Defended a multinational technology company in multiple matters involving claims of retaliation and discrimination by employees and former employees.
  • Retained by the Board of Directors of a multinational auto parts manufacturer to conduct an internal investigation in response to derivative suit and shareholder demand.
  • Regularly represents parties seeking to enforce or defend against enforcement of non-compete agreements, utilizing both pre-litigation negotiation and litigation to further client interests.
