Biography
Ben is first chair litigator with extensive trial and appellate experience who helps clients solve their most difficult legal problems. He has taken numerous cases to trial in state and federal courts and has presented oral argument in more than seven appeals in the Fourth and Eleventh Circuits in addition to numerous state appellate courts, often securing precedent-setting victories across practice areas. Ben has also authored briefs in various other federal courts of appeal, including petitions to the U.S. Supreme Court. Recognized for his strong written and oral advocacy, Ben represents his clients from trial through appeal.
Ben is a member of the firm’s Appellate Team and Business & Commercial Disputes Practice Group, and his nationwide litigation practice focuses on business litigation and regulatory compliance. His representations have involved nationwide class actions, products liability, trade secrets, intellectual property, and regulatory compliance issues. Ben also has an active pro bono practice. He has helped undo wrongful convictions with the Innocence Project, has worked on death penalty cases, and recently won a four-day trial arising from a real property dispute and breach of contract.
In addition to his litigation practice, Ben also serves as a trusted business advisor and helps clients identify and address legal needs. He has experience advising startup companies on corporate governance and capital raising efforts. He also advises on compliance issues, as well as negotiating, drafting, and analyzing various types of corporate agreements.
Prior to joining BCLP, Ben was a litigation associate at a nationwide firm and clerked for the Honorable Robert B. King on the U.S. Court of Appeals for the Fourth Circuit. While in law school, Ben served as Editor-in-Chief of the West Virginia Law Review, the President of the Fund for Law in the Public Interest, and as a member of the Supreme Court Clinic, where he represented indigent clients on appeal.
Ben has been recognized for years by Super Lawyers as a “Rising Star” and by Best Lawyers as “One to Watch.”
