Partners Present on ITAR Compliance for Export Compliance Training Institute

Washington Partners Susan Kovarovics and Megan Gajewski Barnhill will discuss the compliance obligations of US persons under the International Traffic in Arms Regulations (ITAR), and the consequences of non-compliance, on Dec. 17 for the Export Compliance Training Institute. 

In 2020, the US State Department’s Directorate of Defense Trade Controls (DDTC) issued updated guidance regarding the scope of defense services and when the activities of US persons working outside the United States are regulated by the ITAR. This webinar will outline the practical impacts of DDTC’s guidance for US persons and for companies that employ them outside the United States. Kovarovics and Barnhill will use case studies to illustrate the types of activities that fall within the scope of defense services regulated by the ITAR and key compliance considerations.

Discussion will include suggestions for tailoring ITAR compliance programs to address the role of US persons outside the United States; understanding which types of export authorization are appropriate to cover the activities of US persons working outside the United States in your organization; and information to better identify which situations fall within the scope of defense services regulated under the ITAR.

Leader of BCLP’s International Trade Practice, Kovarovics counsels US and non-US private and publicly held companies in a variety of industries. Her practice has a specific focus on matters involving ITAR, the Export Administration Regulations (EAR), sanctions administered by the Office of Foreign Assets Control (OFAC), US antiboycott laws and the Foreign Corrupt Practices Act (FCPA). Barnhill counsels US and non-US clients on regulatory matters related to international business transactions. Specifically, she advises clients on regulatory issues related to international trade, including US export controls, trade sanctions, antiboycott, and registration and reporting under the Foreign Agents Registration Act (FARA).
