BCLP Partner Lauren Caisman was quoted Jan. 17 by Legaltech News on what to expect for cybersecurity in 2023 as part of an 11-part series of 2023 predictions. “2022 was the most active year for biometric privacy litigation since Illinois enacted the first biometric privacy statute of its kind in 2008,” she said. “Newly filed lawsuits poured in and the Texas AG stepped into the space, filing against two FAANG companies for the allegedly unauthorized capture/use of biometric identifiers. For the first time, a jury rendered a biometric privacy verdict, but expect post-judgment litigation. Two rulings from the Illinois Supreme Court—anticipated to address the statute of limitations/accrual of BIPA claims—are also keenly awaited. Litigation will continue in 2023 over almost every aspect of the BIPA.”
