BCLP Partner Bryan Keyt was quoted Sept. 2 by SHRM (Society for Human Resource Management) regarding OSHA’s August guidance on COVID-19 vaccine requirements for employers, as well as further recommendations for those working in high-risk COVID-19 hot spots.  "This is guidance, not a final regulation that has the force of law,” Bryan said. “However, as the virus continues to change and spread, in recent weeks we have seen a number of major employers in the technology, airline and food delivery space begin to require vaccination by their employees.” He also cautioned that an employer choosing not to require vaccination and that has not taken other appropriate action – such as implementation of barriers, respiratory protection and social distancing – could be liable under the general duty clause.
