On February 2, 2022 the French Cour de Cassation pronounced a judgement concerning the protection of consumers against unfair terms.
Elodie Valette, Litigation partner in BCLP's Paris office, commented on this decision in La Semaine Juridique: "The judgment is part of a jurisprudential construction from which it follows that no limit seems to be able to be placed on the judge's ability to find of his own motion that a term is unfair.”
