BCLP Law Clerk Ryan Fitzpatrick and Partners Cory Smith and George Chen co-authored an article published June 5 by Law360 concerning a recent decision in the U.S. Court of Appeals for the Federal Circuit, which discusses important details regarding how claim language and claim drafting can affect the breadth of protection under a patent. “In a Feb. 17 Lite-Netics LLC v. Nu Tsai Capital LLC decision, the Federal Circuit reviewed a decision from the U.S. District Court for the District of Nebraska,” they wrote. “[T]he Federal Circuit concluded that the district court abused its discretion in finding the patent claims to require a singular magnet [because] … there was nothing in the specification or prosecution history that identified, criticized or disclaimed a particular structure for the magnet, thereby preserving the doctrine of equivalents for the magnet.”
