International Arbitration team author article on the Reform of the English Arbitration Act

BCLP Partner and Global Co-Leader of International Arbitration, George Burn, together with Senior Associate Nadia Hubbuck, have had an article published in the March 2024 Issue of the Transatlantic Law Journal. The article covers Reform of the English Arbitration Act 1996 – The Aggregation of Marginal Gains or a Missed Opportunity?

The article examines the main amendments proposed in the Arbitration Bill, which was introduced to the UK Parliament in November 2023 following the Law Commission’s review of the Arbitration Act 1996. The Law Commission have recommended various reforms to the Act to improve clarity and certainty of the arbitral process and to maintain the attractiveness of England and Wales as a destination for dispute resolution.

The article expands on themes explored in BCLP’s 2022 Annual Arbitration Survey: The Reform of the Arbitration Act 1996. The results of the survey were shared with the Law Commission as part of its consultation process. The Survey has also been referenced in submissions to the Special Public Bill Committee that is currently reviewing the Arbitration Bill.
