BCLP Roundup Team helps secure 15th favorable outcome for Monsanto

A BCLP cross-office litigation team played a critical role in securing another victory for client Monsanto in the Philadelphia Court of Common Pleas. The trial involved claims that a plaintiff's use of Roundup caused her to develop Non-Hodgkin's lymphoma.

After a three-week trial, the 12-person jury delivered a complete defense verdict after six hours of deliberation. The Philadelphia Court of Common Pleas is notorious for being among the most challenging jurisdictions for corporate defendants, and is known for delivering nuclear verdicts.  The Judge also granted co-defendant Nouryon a non-suit, ruling as a matter of law that Plaintiff failed to prove any of its claims against Nouryon and dismissing all of Plaintiff’s claims against it, outright. 

After three plaintiff’s verdicts in a row, as the Roundup trials started in the Philadelphia Court of Common Pleas towards the end of last year, the BCLP team in Philadelphia helped turn the tide in a favorable way for our clients, finishing 2024 with three jury-delivered defense verdicts. 

This marks the 15th favorable outcome for Monsanto in the last 22 trials, further bolstering the company’s winning approach of entering trials backed by strong scientific evidence. The recent wins also help to reinforce the consensus from scientific agencies worldwide affirming the safety of glyphosate-based herbicides.
