BCLP Partner David B. Schwartz was quoted in Global Competition Review discussing Federal Trade Commission (FTC) Chair Andrew Ferguson’s decision to bar the agency’s political appointees from participating in American Bar Association (ABA) events, holding leadership roles, or maintaining memberships, citing concerns about the organization’s alignment with defense attorneys and Big Tech. The move, detailed in a letter to FTC staff, marks a significant shift in the agency’s relationship with the ABA.

David, a partner at BCLP and former FTC attorney, noted the parallels between Ferguson’s stance and prior restrictions implemented under Chair Lina Khan.

“By the end of her term, Khan had reconsidered,” David said. “Let’s see how Ferguson’s views change, if at all.”

David is a key member of the firm’s Antitrust and Competition Practice Group. Drawing on extensive experience in antitrust litigation and policy, he often provides strategic counsel on enforcement actions, regulatory matters, and government investigations.
